Anyone hear about this incident?... (per my friend Italo...)

New word is that they will be confiscating bikes if you get caught riding at Ted W.

One of the guys who was at the bottom Meadowbrook parking lot without a bike and a yellow carbon copy of a ticket for trespassing among other city codes violated by off-roading within city limits.

As I’m sure you already know, a bicycle is technically considered a “motor vehicle” in the state of California.

And

Ted Williams is within the city limits…………and (although I’ve never personally seen them myself) there are NO TRESSPASSING signs posted

The guy said that the 5-0 were watching him for a while as he was riding up on the trails and when he came down to load his bike…………..BAM……..they confiscated the bike, gave him a citation and threatened to arrest him should it happen again. Plus they told him to tell all his buddies.

I didn’t personally see this happen but I have seen 5-0 driving around the parking area.

If you ask me, they were probably using him to make an example to all mtb-rs

Hey Mudd, when was this?

Was it Fish and Game or SDPD that confiscated the bike and gave him a citation, if it was PD then this opens up a hole new can of worms, it means the property owner filed a complaint or maybe the Fish and Game informed the property owner of the trespassers.

SDMBA has a on site meeting with DFG sometime next week and I will ask way they are confiscating bikes and giving citation.

I did hear a dirt bike riding up along the ridge one time I was out there in the evening. So yeah, if it's making loud motor noise, neighbors will definitley complain, and law enforcement can definitely issue a citation. If this becomes an issue, I will just park somewhere else and ride to any of half dozen trailheads.

BTW, maps show the eastern part of TW (where all the trails are) w/in Poway city limits, not San Diego city limits.

Not true. In most states, laws consider bicycles vehicles, but not a motor vehicles. CA is an exception. CA law considers bicycles "devices," not vehicles.

I'm pretty sure the residents are going to just absolutely love people blowing air horns all day just outside their backyards everytime some crackhead gets scurred his bikes gonna get taken away. I can see that being a huge hit.

Mulling this over further, this report is either bogus, someone left out specific details (i.e. they were on a dirt bike), or law enforcement grossly over stepped their bounds in a definition meant for the road. You can't have your cake and eat it too. If law enforcement is taking a position that riding a bike at TW is violating (Poway) city codes by off-roading within city limits, then if you ride any of the south Poway trails, Iron Mountain, Poway Lake/lower Mt Woodson, wouldn't you also be in violation? But we all know that these areas are clearly open to mountain bikes.

You can't always use rational thought to philosophize irrational behavior. Especially government behavior.
